  1. ACCEPTANCE OF TERMS
    By accessing or using the USFitness LLC website (the "Site") or purchasing products from us, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Site or purchase our products.

  2. ELIGIBILITY
    You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products from USFitness LLC.

  3. PRODUCTS
    We sell new and used gym and fitness equipment. Product descriptions, images, and pricing on the Site are provided for informational purposes and are subject to change without notice. We make reasonable efforts to display product information accurately, but we do not warrant that descriptions, images, or pricing are error-free.

Used equipment is sold "as is," as described in our Liability Disclaimer — please review it before purchasing used items.

  1. PRICING AND PAYMENT
    All payments are currently processed in person at the time of purchase. Prices are subject to change without notice and do not include applicable sales tax unless stated otherwise. In the event of a pricing error on the Site, we reserve the right to correct the error and to cancel or decline any order affected by it.

  2. ORDERS AND AVAILABILITY
    Product availability is not guaranteed and may change without notice. We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud or error.

  3. RETURNS, EXCHANGES, AND REFUNDS
    All sales are final. USFitness LLC does not offer refunds, returns, or exchanges for change-of-mind purchases, whether the equipment is new or used.

This policy does not apply to remedies you may be entitled to under applicable law for defective new equipment covered by a manufacturer's warranty or under the California Song-Beverly Consumer Warranty Act — those claims should be directed to the manufacturer or to us per the applicable warranty terms, not treated as a "return."

Note: this no-refund policy is also posted at our physical location, as required under California law.

  1. EQUIPMENT USE, ASSEMBLY, AND SAFETY
    Customers are responsible for the proper assembly, installation, and safe use of all equipment purchased, in accordance with manufacturer instructions. USFitness LLC is not a medical provider, and nothing on this Site constitutes medical or fitness advice. Consult a physician before beginning any exercise program, particularly if you have a pre-existing health condition.

  2. LIMITATION OF LIABILITY
    Use of our products and this Site is subject to the Liability Disclaimer posted on our Site, which is incorporated into these Terms by reference. To the fullest extent permitted by law, USFitness LLC is not liable for indirect, incidental, or consequential damages arising from use of the Site or our products.

  3. INTELLECTUAL PROPERTY
    All content on this Site — including text, images, logos, and design — is the property of USFitness LLC or its licensors and may not be copied, reproduced, or distributed without permission.

  4. PROHIBITED CONDUCT
    You agree not to use the Site to: violate any applicable law; transmit harmful code or malware; attempt to gain unauthorized access to our systems; or interfere with the Site's normal operation.

  5. THIRD-PARTY LINKS
    Our Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site.

  6. PRIVACY
    Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information, including for email marketing communications you opt into.

  7. DISCLAIMER OF WARRANTIES
    THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

  8. GOVERNING LAW
    These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

  9. DISPUTE RESOLUTION
    Informal resolution first: If a dispute arises, you agree to first contact us at [email] so we can attempt to resolve it informally.

Binding arbitration: If informal resolution doesn't work, any dispute arising out of or relating to these Terms, your purchase, or your use of the Site will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court instead of arbitration if it qualifies. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and will take place in [County], California, or another mutually agreed location, or may be conducted by phone, videoconference, or written submission where permitted by the arbitrator.

No class actions: Disputes must be brought on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

  1. CHANGES TO THESE TERMS
    We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

  2. SEVERABILITY
    If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
