These Terms and Conditions ("Terms") apply to your use of the USFitness LLC website (the "Site") and to any purchase you make from us. Please read them carefully.

1. ACCEPTANCE OF TERMS

By accessing or using the Site, sending us a request, or purchasing products from us, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

2. ELIGIBILITY

You must be at least 18 years old, or the age of majority where you live, to purchase products from USFitness LLC.

3. PRODUCTS

We sell new and used commercial and home gym equipment. Product descriptions, images and prices on the Site are provided for information and may change without notice. We make reasonable efforts to show accurate information, but we do not warrant that descriptions, images or prices are error-free.

Used equipment is sold "as is". Please review the condition details we share with you before buying used equipment.

4. REQUESTS AND ORDERS

Products are not purchased directly through the Site. When you send a request, we review it and confirm pricing, availability and shipping with you. An order is only confirmed once we have agreed the details with you and received your payment.

We may decline or cancel any request or order at our discretion, including when a product is unavailable, a price was displayed in error, or we suspect fraud.

5. PRICING AND PAYMENT

We do not process payments through the Site. Payment is arranged directly with us after your order details are confirmed. Prices may change without notice until your order is confirmed. Unless your quote says otherwise, prices do not include sales tax, shipping, or import duties and taxes for international orders. If a price on the Site is wrong, we may correct it before confirming your order.

6. SHIPPING AND DELIVERY

We ship across the United States, Mexico and Latin America by freight. Delivery times are estimates. New equipment typically ships about two weeks after payment, and we schedule the delivery date with you. Please inspect your equipment on arrival as described in our Refund Policy.

7. RETURNS, EXCHANGES AND REFUNDS

All sales are final. USFitness LLC does not offer refunds, returns or exchanges for change-of-mind purchases, whether the equipment is new or used. Full details, including manufacturer warranties and your rights under California law, are in our Refund Policy.

8. EQUIPMENT USE, ASSEMBLY AND SAFETY

You are responsible for the proper assembly, installation and safe use of all equipment, following the manufacturer's instructions. USFitness LLC is not a medical provider, and nothing on the Site is medical or fitness advice. Consult a physician before beginning any exercise program, especially if you have a pre-existing health condition.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, USFitness LLC is not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products.

10. DISCLAIMER OF WARRANTIES

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. MANUFACTURER WARRANTIES ON NEW EQUIPMENT ARE DESCRIBED IN OUR REFUND POLICY.

11. INTELLECTUAL PROPERTY

All content on the Site, including text, images, logos and design, belongs to USFitness LLC or its licensors and may not be copied, reproduced or distributed without permission. Brand names and trademarks of equipment manufacturers belong to their respective owners.

12. PROHIBITED CONDUCT

You agree not to use the Site to break any law, send harmful code or malware, try to gain unauthorized access to our systems, or interfere with the Site's normal operation.

13. THIRD-PARTY LINKS

The Site may link to third-party websites. We are not responsible for the content, accuracy or practices of any third-party site.

14. PRIVACY

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use information, including for email communications you choose to receive.

15. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

16. DISPUTE RESOLUTION

Informal resolution first: if a dispute arises, please contact us first at usfitnessgymequipment@gmail.com so we can try to resolve it informally.

Binding arbitration: if we cannot resolve it informally, any dispute arising out of or relating to these Terms, your purchase or your use of the Site will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and will take place in San Diego County, California, or another location we both agree on, or by videoconference or written submission where the arbitrator allows.

No class actions: disputes must be brought on an individual basis only, and not as a plaintiff or class member in any class, collective or representative proceeding.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. The "Last updated" date above shows the latest version. Continuing to use the Site after changes are posted means you accept the updated Terms.

18. SEVERABILITY

If any part of these Terms is found unenforceable, the rest of these Terms remains in full force and effect.
